Terms of Service
1. Acceptance of these Terms
These Website Terms of Service (the “Terms”) are a legal agreement between you and [MyWave legal entity name] (“MyWave”, “we”, “us” or “our”). They govern your access to and use of the website located at mywave.ai and any related MyWave web pages, content, demonstrations and portals that link to these Terms (together, the “Website”).
By accessing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Website. The Website is intended for business and professional users; by using it you represent that you are at least 18 years old and are accessing it for legitimate business purposes.
2. Relationship to other agreements
The Website is provided for general information and to allow you to learn about MyWave, request a demonstration, and access certain MyWave portals where authorised. These Terms govern your use of the Website only.
Your access to and use of the MyWave Innovation Hub, the MyWave Core Platform, any Waves, runtime deployments, professional services or other paid or licensed MyWave products and services are governed by a separate written agreement between you (or your organisation) and MyWave (for example a Master Partner Agreement, master subscription agreement or order form) (a “Platform Agreement”). Nothing on the Website and nothing in these Terms grants you any right to access or use those products and services, and in the event of any conflict between these Terms and a Platform Agreement in respect of the products and services it covers, the Platform Agreement prevails.
3. Permitted use of the Website
Subject to your compliance with these Terms, MyWave grants you a limited, non-exclusive, non-transferable, revocable right to access and view the Website for your internal business and informational purposes. We may change, suspend, limit or withdraw all or any part of the Website at any time without notice or liability.
4. Accounts and portal access
Certain areas of the Website (such as the Innovation Hub or partner portals) require registration or authorised credentials. Where you are given or create access credentials, you are responsible for:
keeping your usernames, passwords and account information confidential and secure;
controlling against, and not permitting, unauthorised access; and
all activity that occurs under your credentials or account, whether or not authorised by you.
You must notify us promptly at info@mywave.ai if you become aware of any unauthorised use of, or access to, your account. We may suspend or revoke access to any account or portal at any time where we reasonably consider it necessary, including to protect the security or integrity of our systems.
5. Acceptable use
When accessing or using the Website, you must use it only for lawful purposes and you must not:
use the Website for any fraudulent, unlawful, harmful or destructive purpose;
upload, input, store, transmit or distribute any material that infringes any third party’s intellectual property or other proprietary rights, or that is obscene, defamatory, threatening, abusive or otherwise objectionable;
copy, modify, duplicate, republish, frame, scrape or create derivative works from any part of the Website, the MyWave Innovation Hub, the MyWave Core Platform or any related software, except as expressly permitted by us in writing;
decompile, reverse engineer, disassemble or otherwise attempt to derive the source code or underlying structure of any MyWave software or services, except to the extent this restriction is prohibited by law;
introduce any virus, malware or other harmful code, or attempt to gain unauthorised access to, interfere with, disrupt or place undue load on the Website or any systems or networks connected to it; or
license, sell, transfer, assign or otherwise make the Website or any MyWave software, content or documentation available to any third party except as expressly authorised.
We may investigate any suspected breach of this section and may report suspected unlawful activity to the relevant authorities.
6. Intellectual property
The Website and all of its contents — including text, graphics, logos, images, video, software, the MyWave Innovation Hub, the MyWave Core Platform, Waves, Reusable Wave Components, documentation and their look and feel — are owned by MyWave or its licensors and are protected by intellectual property laws. As between you and MyWave, MyWave and its licensors retain all intellectual property rights in and to the foregoing.
“MyWave”, the MyWave logo and other MyWave names and marks are trademarks of MyWave. You may not use them without our prior written consent. Except for the limited right to view the Website granted in these Terms, no right or licence is granted to you in respect of any MyWave intellectual property.
7. Feedback
If you send us any feedback, comments, ideas or suggestions about the Website or any MyWave product or service, that feedback is not confidential and we may use it without restriction or any obligation to you, including to develop and improve our products and services. All intellectual property rights arising from such feedback vest exclusively in MyWave.
8. Third-party services and links
The Website may contain integrations with, or links to, third-party websites, content and services (for example social media, video hosting and form-submission tools). These are provided for convenience only, do not form part of the Website, and are not under our control. We do not endorse and are not responsible for any third-party websites, content or services, and your use of them is at your own risk and subject to their own terms.
9. Artificial intelligence and automated outputs
MyWave provides agentic AI technology, and the Website may include AI-generated content, demonstrations, sample agents and similar materials. Any such materials are provided for general illustration and information only. AI systems can produce outputs that are incomplete, inaccurate or unexpected, and demonstration content does not represent the configuration, guardrails or results you would obtain in a governed production deployment.
You should not rely on any AI-generated or automated output on the Website as professional, legal, financial, regulatory or other advice, or as a substitute for your own independent judgement and verification. Any production use of MyWave agents, including human oversight and the configuration of controls, is governed by your Platform Agreement and not by these Terms.
10. Disclaimers
To the maximum extent permitted by law, the Website and all content and materials on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory. We do not warrant that the Website will be uninterrupted, timely, secure, error-free or free of viruses or other harmful components, or that any content is accurate, complete or current. All warranties, conditions and representations not expressly set out in these Terms are excluded to the fullest extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, MyWave will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any of the following arising out of or in connection with your use of, or inability to use, the Website:
any indirect or consequential loss or damage;
any loss of profits, revenue, business, goodwill or anticipated savings (whether direct or indirect); or
any loss or corruption of data.
To the maximum extent permitted by law, MyWave’s total aggregate liability arising out of or in connection with the Website and these Terms will not exceed the amount you paid to MyWave, if any, for access to the Website in the 12 months before the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
12. Indemnity
You agree to indemnify and hold harmless MyWave and its affiliates, and their respective officers, employees and agents, from and against all losses, liabilities, claims, damages and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.
13. Privacy
Our collection and use of personal information in connection with the Website is described in our Privacy Policy, which forms part of these Terms. Please review it to understand our practices.
14. Suspension and termination
We may suspend, restrict or terminate your access to all or any part of the Website at any time, with or without notice, including if we reasonably believe you have breached these Terms. The sections of these Terms that by their nature should survive termination — including those on intellectual property, feedback, disclaimers, limitation of liability, indemnity and governing law — will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes take effect when posted on the Website, and your continued use of the Website after that point constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
16. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of [England and Wales / the State of New York, USA], without regard to its conflict of laws principles. You and MyWave submit to the exclusive jurisdiction of the courts of [England / the State of New York], except that MyWave may seek urgent or injunctive relief in any court of competent jurisdiction.
